1. TERMS AND CONDITIONS - INTRODUCTION

By accessing the GulliverWAY website and/or using the services offered on the GulliverWAY website, you declare that you have read, understood, and accepted the terms and conditions outlined below (including the privacy policy).

6. For "tourist product," we mean a tourist product that is not assimilated to a "Product or Package" but can be purchased individually; for example, hotels, transfers, activities, car rentals, etc.
7. For "Product or Tourist Package," we mean the trip or vacation as described at the following link
8. For "Terms and Conditions," we refer to these Terms and Conditions of use of the Site, which constitute a legally binding agreement between the User and the Owner.
9. For "User," "you," "your," and similar terms, we mean the natural or legal person using the Site.
10. For "Consumer User," we mean a natural person who requests a service offered by the Site for purposes unrelated to any business or professional activity they may engage in.

4. SITE PRESENTATION AND RELATED SERVICES

1. The Site is dedicated to the presentation and purchase of Products or Tourist Packages, allowing the User to:
   • Check the available destinations and dates related to the products and Products or Tourist Packages presented by the Owner on the Site.
   • Submit contact requests to the Owner to receive more information about the presented Products or Tourist Packages.
   • Customize their own Tourist Product or Package by selecting preferred services.
   • Complete the purchase of a Tourist Product or Package.
2. The service is reserved for adult users.

5. PORTAL OPERATION

1. GulliverWAY endeavors, to the extent reasonably possible, to maintain a standard of commercial reasonableness to ensure that the Site is always accessible. However, the administrator shall not be liable if, for any reason, the Site may be unavailable, even for limited periods of time.
2. To ensure the User's best possible experience of the Service, the Owner reserves the right to interrupt it for system maintenance or updates, providing constant updates to inform the User.

6. ACCOUNT CANCELLATION

1. The Owner reserves the right, at its sole discretion, and without such exercise giving rise to any claim of non-compliance or violation of these Terms and Conditions, to suspend or cancel the User's account if it believes that:
   • The User has violated the Terms and Conditions.
   • Access to or use of the Service could cause harm to the Owner, other users, or third parties.
   • The User's use of the Site may constitute a violation of applicable law or regulations.
   • nvestigations are conducted as a result of legal actions or involvement of Public Authorities.
   • The User's account is deemed by the Owner, in its sole discretion and for any reason, to be inappropriate, offensive, or in violation of the Terms and Conditions.
   • There are reasonable grounds to believe that the Service is or may be used by unauthorized third parties.
   • An event of force majeure or circumstances that, at the Owner's sole discretion, require emergency interventions or the resolution of security issues, endangering the entire infrastructure and/or individuals and/or property (in the latter case, the User's account will be reinstated as soon as the Owner, at its discretion, deems that the cause of the Service suspension has been effectively removed or eliminated).
   • The User is involved, in any capacity, in any judicial or extrajudicial dispute of a civil, criminal, or administrative nature, and, in any case, if such dispute may involve actions or measures against the Service or the Owner.
   • The suspension is requested by any judicial authority.
2. Any suspension of the account attributable to the User does not prejudice the right of the Owner to seek compensation for any damages suffered.

7. SITE REGISTRATION

1. The User is not required to register to explore and use the Site.
2. Site registration is done through the completion of the forms provided, where the User must provide the required mandatory data to the Owner, while accepting the respective Privacy Policy and Terms and Conditions.
3. Each registration on the Site is valid for a single User. Any identification code, password, username, or similar information is part of the security systems and procedures activated by GulliverWAY to protect the system and data stored on the Site. Therefore, they cannot be disclosed to anyone, not even within a specific group. GulliverWAY reserves the right to disable the identification code, password, and/or username of any Site user if, in the sole discretion of GulliverWAY, there has been a violation of any clause in the Terms and Conditions.
4. The responsibility for the confidentiality and use of the password lies solely with the User, who assumes all associated risks.
5. Registered Users can deactivate their account, request its deletion, or discontinue the use of the Service at any time by contacting the Owner directly. With the deletion of the account, the User will only be able to visit the Site but will not have access to additional services that require registration.

Users are free to explore the Site without providing any personally identifiable information. However, to access certain additional features of the Site, the User will need to provide the required data in the respective forms, which may include the User's age. In any case, the use of the additional functions of the Site (e.g., cost calculation and purchase of a Tourist Product or Package) is only permitted for adult Users. 8. USER BEHAVIOR AND USER-OWNED MATERIAL

1. Except for personal data, which will be processed in accordance with the privacy policy, any material, content, transmitted, or inserted on the Site will be considered non-confidential and non-proprietary. Therefore, GulliverWAY assumes no obligation with respect to such information and materials and is authorized to obtain copies, transmit, disclose, and use such information and materials, both for commercial purposes and other purposes.
2. The User agrees not to insert or transmit on or from the Site any material that is:
   • Intimidating, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, inciting hatred or discrimination, threatening, scandalous, inciting, blasphemous, violating confidentiality obligations, infringing on privacy, or causing annoyance or harm.
   • For which necessary licenses or approvals have not been obtained.
   • Represents or encourages behavior that could be considered criminal, incurring the liability of anyone, contrary to law, public order, or good manners, or infringing on the rights of third parties anywhere in the world.
   • Causes damage (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, defective components, corrupted data, or other software with harmful content or capable of causing damage). The User cannot abuse the Site (for example, by engaging in hacking activities).
3. GulliverWAY will actively cooperate with public authorities conducting investigations and comply with any order from a judicial authority that requires or orders GulliverWAY to disclose the identity or locate the individuals who transmit or insert material that does not comply with the law and/or the above provisions.
4. In all cases covered by points 8.2 and 8.3, GulliverWAY is authorized to proceed as per point 6.1.

9. INDUSTRIAL AND INTELLECTUAL PROPERTY – CONTENT AVAILABLE ON THE SITE – UNAUTHORIZED USE OF THE SITE

1. GulliverWAY is the exclusive owner of the content on the Site, including - by way of example and not exhaustively - texts, documents, images, logos, photographs, page layouts, design, know-how, and products offered for sale; some of the aforementioned content may be protected by copyrights, trademarks, patents, designs, and/or other industrial and intellectual property rights recognized by Italian and international laws.
2. The Owner grants the User, for the entire duration of the contract, a personal, non-transferable, non-exclusive license for strictly personal and non-commercial purposes, limited to the User's device for using such content. Therefore, it is expressly prohibited for the User to, for example but not exhaustively, copy and/or download and/or share (except as outlined below), modify, publish, transmit, sell, sublicense, process, transfer/assign to third parties, create derivative works in any way from the content, including third-party content, available on the Site, nor allow third parties to do so through the User or their device, even unknowingly.
3. Where expressly indicated on the Site, the User, for personal use only, may be authorized to download and/or copy and/or share certain content made available on the Site, provided they faithfully reproduce all copyright notices and other information provided by the Owner.
4. By sending, publishing, or displaying content on or through the Site, the User grants the Owner an unlimited, worldwide, non-exclusive, free, and sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content using any currently available or subsequently developed means of distribution.
5. The User may use services and content included on the Site provided by third parties, but must first review the terms and conditions of such third parties and accept them. Under no circumstances shall the Owner be held responsible for the proper functioning or availability, or both, of services and content provided by third parties.
6. The User is not allowed to:
   • Perform reverse engineering, decompile, disassemble, modify, or create derivative works based on the Site or any portion thereof.
   • Bypass computer systems used by GulliverWAY or its licensors to protect the content accessible through the Site.
   • Copy, store, modify, alter, prepare derivative works, or in any way modify any of the content provided by the Site.
   • Use any robot, spider, site search/retrieval application, or any other automatic device, process, or means to access, retrieve, scrape, or index any portion of the Site or its contents.
   • Rent, lease, or sublicense the Site.
   • Defame, offend, harass, engage in threatening practices, threaten, or otherwise violate the rights (such as privacy and publicity rights) of others.
   • Distribute or publish illegal, obscene, unlawful, defamatory, or inappropriate content.
   • Unlawfully appropriate another User's account.
   • Use the Site to approach users to promote, sell, or advertise products or services of any kind.
   • Use the Site in any other improper manner that violates these Terms and Conditions. In this case, GulliverWAY is authorized to take action as indicated in clause 6.1.
7. All trademarks, both figurative and nominative, and all other signs, trade names, service marks, denominative marks, trade designations, illustrations, images, logos, appearing on the Site regarding GulliverWAY are and remain the exclusive property of the Owner or its licensors and are protected by current trademark laws and related international treaties. All trademarks, both figurative and nominative, and all other signs, trade names, service marks, denominative marks, trade designations, illustrations, images, logos regarding third parties and the content published by such third parties on the Site are and remain the exclusive property of said third parties or their licensors and are protected by current trademark laws and related international treaties. The Owner does not own the ownership of such intellectual property and can only use it within the limits and in accordance with the contracts concluded with such third parties and for the purposes outlined therein.

10. DISCLAIMER

1. The User is responsible for using the Site independently and at their sole risk, with GulliverWAY disclaiming any responsibility for any damage or harm suffered by the User in any way as a result of accessing, using, or downloading any material of any kind present on the Site, including viruses, malware, or other malicious electronic content.
2. GulliverWAY is not responsible for the content of any other website that may be made accessible through links or multimedia connections on the Site, with the understanding that such links are provided solely to allow the User to access more comprehensive information. The User is not authorized to create links and connections to the Site without prior written consent from GulliverWAY.
3. GulliverWAY is also not liable for: a) any losses directly resulting from a breach of these Terms and Conditions; b) any loss of business opportunities and any other losses, even indirect, possibly suffered by the User (including, by way of example and not exhaustively, loss of business, revenue, income, presumed profits or savings, loss of contracts or business relationships, loss of reputation or goodwill; c) damages or losses resulting from interruptions or malfunctions of the Site due to force majeure events or events beyond the control of the Owner, including, by way of example and not exhaustively, breakdowns or interruptions in telephone or electrical lines, the internet network, or other transmission tools, website unavailability, strikes, natural events, viruses, and cyberattacks, interruptions in the provision of third-party products, services, or applications; d) misuse of the Site by the User or third parties.
4. The User agrees to indemnify the Owner (as well as any companies controlled or affiliated with the Owner, its representatives, administrators, agents, licensors, partners, and employees) from any obligation or liability, including any legal expenses incurred to defend against legal actions, that may arise in response to damage caused to other users or third parties in relation to content uploaded online, violation of legal terms or these Terms and Conditions.
5. The Owner reserves the right to decide to interrupt or suspend the display of certain content published by the User or third parties in the event that: a) complaints are received from other users; b) a report of intellectual property rights violation is received; c) it deems it necessary in anticipation of, or in response to, legal actions; d) such action is required by the Public Authority; e) it believes that such content, remaining accessible through the Site, could jeopardize users, third parties, the availability of the Service, and/or the Owner itself.

11. DATA PROCESSING

For information regarding the use of personal data, the User should refer to GulliverWAY's privacy policy, which is available at the following link, and constitutes an integral and substantial part of these Terms and Conditions.

12. APPLICABLE LAW AND JURISDICTION

1. These Terms and Conditions are governed by Italian law.
2. For any dispute relating to these Terms and Conditions, their interpretation, execution, and validity, the exclusive jurisdiction shall be the Court of Cuneo.

13. AMENDMENTS TO THESE TERMS

The Owner reserves the right to make changes to these Terms and Conditions at any time by notifying the User through their publication on the Site. The User who continues to use the Site following the publication of the changes accepts the new Terms without reservation.

14. ASSIGNMENT

The Owner reserves the right to transfer, assign, novate, or subcontract all or some of the rights arising from these Terms and Conditions, provided that the rights of the User are not prejudiced. The User may not assign or transfer their rights or obligations under these Terms and Conditions in any way without written authorization from the Owner.

15. IMAGE RIGHTS RELEASE

The User grants the Owner, free of charge, the right to use, disseminate, reproduce, process, modify, publish, communicate to the public, transmit - on any analog, electronic, computer, and/or digital medium (including, for example, transmission systems via air, cable, satellite, web, including social network pages such as Facebook, Instagram, Twitter, Youtube) - their portrait and image contained in the videos and images that may be created in connection with the purchased Product or Tourist Package. The User also: a) assigns, free of charge, all rights of any kind and nature existing in such images, necessary for their commercial, promotional, and advertising exploitation; b) expressly declares to be fully satisfied and to have nothing to claim for any reason or title (e.g., of an economic nature) from the Owner, its assignees, and/or successors in general from anyone who uses and exploits such images; c) guarantees the Owner the peaceful enjoyment of all rights assigned under the aforementioned article and indemnifies and agrees to hold the Owner and/or its successors harmless from any possible action and/or claim by third parties relating to the images and their exploitation, assuming sole responsibility and cost for any related liability. In any case, the Owner will not use the images in contexts or in ways that prejudice the honor, reputation, and dignity of the portrayed and/or photographed User..

16. COMMUNICATIONS

All communications related to GulliverWAY must be sent using the contact information provided in these Terms and Conditions.

18. INEFFECTIVENESS AND PARTIAL NULLITY

In the event that any clause of these Terms and Conditions is found to be null, invalid, or ineffective, that clause will be disregarded while the remaining clauses will remain fully valid and effective.
